US EB 5 Program

Since its introduction in 1990, the United States Employment Based Category 5 Program provides a special category of immigration Visa for High Net worth international investors. This Program was started with a vision of stimulating the US economy through job creation and capital investment by foreign investors. Under a pilot immigration program first enacted in 1992 and regularly reauthorized ever since, certain EB-5 visas also are set aside for investors in Regional Centers designated by USCIS based on proposals for promoting economic growth.

The EB-5 programme is an immigration visa that allows you and your family to live, work and study in the US permanently. The three biggest advantages of the EB-5 Immigrant Investor Programme are:

Gain US green card: The EB-5 is a US green card – allowing you to reside permanently in the US and, within only five years, become eligible for citizenship. This allows you to live, work and travel throughout the USA – home to a unique culture, incredible personal freedoms, and exceptional quality of life.

Short investment period: While the EB-5 Immigrant Investor Program does require a sizeable investment, your stake is not held indefinitely. It does not require you to manage the day-to-day affairs of a business. You must meet and maintain a USD 500,000 or USD 1m investment in good faith for the two-year conditional residency period, but once you’re granted permanent residency you can pull your investment should you prefer.

Lenient entry requirements: The requirement to gain the EB-5 visa is primarily financial. If you meet the required investment into the required area, and create the required jobs, there aren’t many other criteria aside from some minor fees, a short interview and standard medical exams.

  • Intercompany transfer

  •  If the business in the U.S. is successful, we can change status to EB-1C or EB-5 to get a green card once the investor is in the U.S.
  • No minimum investment amount in the U.S.
  • No minimum job creation in the U.S.
  • Allows for investor and immediate family of investor to immigrate to the U.S.
  • Premium processing available, can have a decision in 15 days
  • Must be ready to relocate to the U.S.
  • Initial Visa is granted for 1 year and additional renewals are granted in
  • 2 year increments for a maximum time of 7 years

E-2 Treaty Trader

  • Allows for foreign investor to start a new business in the U.S.
  • Must invest “Substantial Amount”
  • Good for someone who does not have an existing business and wants to start or buy a business like a café, restaurant or professional services.
  • Allows for investor and immediate family to move to the U.S.
  • Will not lead to green card but can be used to change status to EB-1C or EB-5 to get a green card once in the U.S.
  • Country has to be part of the E-2 Treaty, if country is not part of the Treaty then we can use in conjunction with Grenada CBI passport
  • Can purchase an existing business
  • Initial Visa is issued for 2 years and then the investor can renew for 2 year increments for unlimited number of times
  • Premium Processing available, decision in 15 days

Employment Based Immigration to the United States

EB-3 Unskilled Worker

  • Must be capable of performing unskilled labor (labor requiring less than 2 years of training or experience)
  • Not a temporary job but has to be a full time job
  • Must be sponsored by employer
  • Labor certification must be obtained
  • Allows for spouse and children under the age of 21 to relocate to the United States with the worker
  • Process could take up to 2 years
  • Will lead to a green card
